Aims and objectives

The general aim of the unit is to make students aware of the legal framework governing the law of intellectual property law in Australia. This unit will provide an overview of the key areas of intellectual property law and its application in today’s global economy, with a focus on some of this area’s most topical and complex issues.
This unit of study will provide an introduction to intellectual property law in Australia. Through an examination of the key regulatory frameworks for intellectual property law with a special emphasis on trademarks, domain names, copyright, patents and designs. Students will gain an understanding of the Trade Marks Act 1995 (Cth), the Copyright Act 1968 (Cth), the Patents Act 1990 (Cth) and the Designs Act 2003 (Cth) and how these statutes regulate intellectual property in Australia. This unit will also address contemporary intellectual property challenges and policies from a legal and business perspective, as well as from an economic and social perspective. The law of passing off and the doctrine of confidential information as well as other emerging internet issues will be studied.
 
On successful completion of this unit, students should be able to:
1. Identify and explain laws aimed at regulating intellectual property and innovation in Australia including trade marks, domain names, copyright, patents and designs
2. Apply intellectual property laws to hypothetical problems and real life case studies from multiple perspectives, including a business perspective
3. Analyse and critically evaluate the existing law in a rapidly changing field of law, with a focus on current and topical policy issues
4. Create and prepare legal memorandum and legal advices, which recognises the opportunities the law provides to obtain a competitive advantage in the marketplace and the consequences of such opportunities from a legal, business, economic and social perspective
