Library Regulations
Purpose:
- To provide a framework for use and a code of conduct for students and staff of the University that will foster equitable and fair access to the resources, facilities and services of the library for academic pursuit.
- To provide fair and appropriate mechanisms for resolving alleged breaches of regulations.
1. Who can use the Library?
1.1 All currently enrolled students and staff of Swinburne University of Technology who accept these conditions of use.
1.2 Members of the public, including past students and staff are welcome to read or to use the facilities, provided that they too accept the conditions of use. They can borrow from the Library by joining the Swinburne Library Information Service or the Swinburne Alumni Association.
2. Who can borrow from the Library?
2.1 Currently enrolled full-time and part-time students of Swinburne University of Technology
2.2 Full-time and part-time staff of Swinburne University of Technology
2.3 Members of the University Council
2.4 Approved CAVAL and TAFE Reciprocal Borrowers
2.5 Members of the Swinburne Library Information Service and Alumni Association (fees apply)
2.6 Individuals or members of organizations approved as special borrowers by the Director, Information Resources
3. Loan Conditions
3.1 Loans are available only on presentation of a current Swinburne identity card, or approved borrower card.
3.2 Cards are not transferable, i.e. they cannot be used by another person.
3.3 Lost cards must be reported and replaced immediately
3.4 Material borrowed must be returned on or before the due date and time indicated on the loan receipt slip.
3.5 You must accept personal responsibility for the care of all items borrowed with your card, and for their return in good condition
3.6 All items must be borrowed at the appropriate service desk before you leave the Library.
3.7 Most items from Reserve Collections are available for use in the library only and should not be taken out of the Library.
3.8 Items borrowed should normally be returned through the appropriate chutes.
3.9 Overdue items should be returned to the appropriate desk inside the Library so that you may pay any fine that is owing.
3.10 If an item is lost or damaged you must report this to the Loans Desk immediately. You will be responsible for either the replacement cost plus an administration charge of $20 plus GST, or for the cost of repair
3.11 The library may recall an item in high demand before it is due for return. You must return the item by the new date specified.
3.12 Swinburne employees must obtain a library clearance before leaving employment with Swinburne to show that all outstanding material has been returned and all penalties resolved.
4. Penalties for Breaches of Loan Conditions
4.1 Fines apply for to late return of loans. Penalties and fines for late return are detailed on the library’s web page at http://www.swin.edu.au/lib/info/fines.htm
4.2 You will not be able to borrow while you still have an item out that is overdue.
4.3 You will not be able to borrow while you have outstanding fines or other charges.
4.4 Borrowing privileges may be suspended for other breaches of loan conditions.
4.5 Exam results will be withheld and students will be ineligible to apply for any award from the University while any item is still overdue or replacement costs or other charges are still outstanding.
4.6 The fine rate for any recalled items not returned by the specified date is $1.50 per day.
4.7 Students and staff who have accrued fines in excess of $80.00 during the previous twelve months will not be authorised for reciprocal borrowing at other libraries.
4.8 Students who are eligible for Inter-Library Loans, but who have accrued more than $80.00 in fines during the previous twelve months, will be ineligible for ILL for 12 months.
4.9 Any item that is not returned within six weeks of the due date, or by the end of the academic year in which it was borrowed, whichever occurs sooner, will be considered as lost. The borrower will then be liable for the cost of its replacement plus an administration fee of $20.00 plus GST.
5. Use of Other Libraries
5.1 Current Swinburne students and staff may be authorised to borrow at other libraries with whom Swinburne has borrowing agreements providing they have no more than $80.00 in accrued fines over the last twelve months
6. Use of Open Access Workstations and Electronic Resources
6.1 Electronic workstations (except for catalogue workstations) may be used only by current Swinburne students and staff and other authorized users.
6.2 All workstation users must comply with relevant legislation and University policies which govern the use of workstations in the Library. Please read the Library workstations conditions of use notice near the workstations.
6.3 Users must comply with all local procedures including booking requirements and time restrictions.
6.4 Breaches of these conditions of use may be subject to the Information Technology (IT) Systems Acceptable Use Policy and Procedure.
7. Compliance with the Copyright Act - Photocopying, Downloading, Printing and Scanning
7.1 Users must abide by the relevant provisions of the Copyright Act. Copyright Notices are displayed near the photocopiers, computers, printers and scanners.
8. Use of Mobile Phones
8.1 Use of mobile phones is permitted in designated areas of Swinburne libraries - designated areas to be those where use will have a limited impact on other library users.
8.2 Use is conditional on good mobile phone manners, including quiet or silent ringing, quiet talking and short conversations.
8.3 Mobile phone users must comply with instructions given to them by staff, such as instructions to make the call somewhere else, leave the library, or speak more quietly.
9. General Conduct
9.1 The library, including the computer areas, is a place for quiet, independent study. All users should behave in a manner that is not disruptive to others and does not constitute an act of misconduct as defined in Regulation 16 - Discipline and the General Misconduct Policy .
9.2 Discussion is permitted only in designated areas.
9.3 Eating and drinking are permitted only in designated areas (no alcohol or hot food).
9.4 Smoking and playing games are not permitted in the library.
9.5 It is a condition of entry to the Library that bags and cases may be inspected on leaving.
9.6 You must present your Swinburne ID card or borrower card on request.
10. Breaches of Library Regulations
In the event of non-compliance with Library Regulations and Conditions of Use, or with University Regulations, one or more of the following may apply:
10.1 Penalties for breaches of loan conditions (see section 4 above).
10.2 Library staff may request a user to produce their ID card or library borrower card.
10.3 Library staff may exclude from the Library, any person who fails to observe Library rules, or damages Library property, or behaves in a disruptive manner.
10.4 Ongoing or serious acts of misconduct, including damage to property will be subject to disciplinary action under University Regulation 16 - Discipline, or the Student Network Disciplinary Procedures.
11. Grievance
11.1 If you are dissatisfied with any punitive action taken by the Library you may have the issue reviewed in accordance with the University’s General Grievance Procedures for Students or the University’s Staff Grievance Policy.
12. Alterations to Library Regulations and Conditions of Use
12.1 One or more of the regulations and conditions of use may be changed by the Vice Chancellor or Vice President, on the recommendation of the Director, Information Resources.
12.2 Regulations and conditions of use may, under special circumstances, be temporarily suspended by the Director, Information Resources. Any change to or suspension of the regulations shall be reported at the earliest opportunity to the Vice Chancellor and Vice President. You will be informed of any change on the library web page, in student newspapers and on library notice boards.
